Dr. Kagan has spent an increasing portion of her time in interferences. These two-party contests determine which of competing applicants made his/her invention first. Such contests are common in biotechnology patent practice. She earned a Ph.D. in Molecular Biology from the University of Wisconsin in 1981 working in the area of antibiotic resistance determinants in bacteria. Dr. Kagan did post-doctoral research on nitrogen fixing bacteria in England. She then apprenticed as a law clerk for the firm, while attending law school at night.
